The following terms and conditions and any other related rules that are adopted by JamesTilstead.com and made available herein (collectively the “Conditions of Sale”) shall apply to all sales of JamesTilstead.com products and services that you (the “Customer” or “you”) may order from JamesTilstead.com, organised and existing under the laws of the United Kingdom of Great Britain (“JamesTilstead.com” or referred to herein as “us”, “our” or “we”).
These Conditions of Sale apply to sales made through the JamesTilstead.com website and invoices sent on behalf of JamesTilstead.com. JamesTilstead.com may modify the Conditions of Sale from time to time, at its sole discretion.
The Conditions of Sale applicable to any order placed through the website or from invoices produced on behalf of JamesTilstead.com, are those in force at the time that you place your order. When you submit payment for your order with JamesTilstead.com, you indicate your acknowledgment and your full acceptance of these Conditions of Sale.
Persons wishing to use the Website will also be deemed, by virtue of such use, to have agreed to be bound by our Website Terms of Use and our Privacy Notice, which are incorporated to these Conditions of Sale by reference.
PURCHASING ELIGIBILITY
Only individuals who (a) have reached the age of majority (eighteen in most countries), and (b) have legal capacity to enter into contracts, may order products or services through the JamesTilstead.com website. Any orders placed in contravention to this provision shall be null and void. By placing an order through the website or from one of our invoices, you represent and warrant that you are a bona fide end-user Customer and will not deliver, sell or otherwise distribute JamesTilstead.com products or purchase JamesTilstead.com products for commercial purposes or any other commercial benefit. If despite our efforts the product or service is no longer available or JamesTilstead.com believes, for legitimate grounds, that an order would violate these Conditions of Sale, JamesTilstead.com may refuse such order.
PRODUCT OR SERVICE AVAILABILITY; QUANTITY
All orders placed through the Website or from one of our invoices are subject to availability and acceptance by JamesTilstead.com.
JamesTilstead.com reserves the right to change the assortment of products and services offered on the website and may limit from time to time the quantity of products and services available.
The product pages of the website can provide you with information regarding products that are currently available for sale through our website. Please note that only those items displaying an “Order Now” button (or similar) are available for sale through the Website. You may also contact the Customer Support Centre (details indicated on the website) and a JamesTilstead.com representative will provide you with further information as to product availability and assist you with your purchase.
PRICES AND TAX
All prices shown on the product pages of the website exclude VAT, and other taxes unless otherwise stated.
JamesTilstead.com reserves the right to modify prices at any time without prior notice. The price of a product displayed on the website, as indicated at the time JamesTilstead.com provides you with a Confirmation of Order, will be honoured by JamesTilstead.com.
Taxes applicable to the customers individual country of residence are the responsibility of the customer, not JamesTilstead.com. The customer should check if they will be required to pay tax or duty before ordering from JamesTilstead.com. In the event of a refund, JamesTilstead.com will not reimburse any taxes paid to government agencies by the customer.
PAYMENT
Payment by bank wire transfer
You may pay by bank wire transfer for purchases of products or services from our website, when agreed via email with one of our support representatives.
After you place an order, JamesTilstead.com will wait until your payment is received before processing your order. If the funds are not credited into our bank account within seven (7) working days after you have placed your order, this order will be cancelled.
JamesTilstead.com will not charge a fee for paying by bank wire transfer, but please ensure that we receive the full amount before we process your order. Please note that some financial institutions may charge you a fee for using a bank wire transfer.
Payment by online payment processor
You may pay by third party online payment processor such as PayPal or Stripe, for purchases of products or services from our website, when agreed via email with one of our support representatives.
CONTRACT AGREEMENT
The JamesTilstead.com mentoring is a 12 month binding agreement between JamesTilstead.com and you "The Customer". Upon making payment to JamesTilstead.com, you are deemed to have entered into this contract. You must commit to the full 12 months. No refunds will be offered prior to the completion of the 12 months contract. If at the end of the 12 months, you are not profitable in accordance with the JamesTilstead.com guarantee, you are entitled to a full refund, which will be issued no later than 28 days from the end of the 12 month contract. This agreement does not affect your statutory right to request a refund sooner if James Tilstead fails to provide the service as promised.
GUARANTEE
By the end of the 12 month mentoring contract, you "The Customer" will be a consistently proftable trader in a live trading account.
"Consistently profitable" means ALL of the following:
1. Your most recent 6 months worth of trades will show a positive expectancy. This means taken as an average, every trade opened can be expected to return a positive value – in other words, returns profit.
2. Your live account balance will be greater than any deposits you have made in to it. In other words, your account balance has grown as a result of profits gained from the market, and you have more money than you deposited.
3. You will understand your trading edge and will have the ability to trade it yourself independently without supervision.
If the above is not true by the end of the 12 month contract, you will be entitled to a full refund of the mentoring fee.
GOVERNING LAW
These Conditions of Sale shall be governed by and construed in accordance with the laws of the United Kingdom, without reference to conflict of law provisions, and with the exclusion of the Convention of International Sale of Goods.
